Terms and Conditions

Terms for buying digital content, courses, memberships and services on krisisnew.xyz. Version 0.2 (draft), effective from the launch of sales. This is a courtesy translation; in case of any discrepancy the Czech version prevails.

1. Who is selling

Kristian Koutek, company ID (IČO) 21802441, registered office Sibiřská 134, 460 10 Liberec, Czech Republic, a sole trader registered in the Czech trade register (Liberec City Hall). Contact: security [at] krisisnew.xyz. I am not a VAT payer; all prices shown are final.

2. What I sell

  • Digital content – premium articles and courses with a one-off payment.
  • Membership – access to reserved content for a recurring payment.
  • Custom services – development, administration and consulting. These are governed by an individual quote or contract; these terms apply to them only as a fallback. A business customer is not a consumer, and the provisions marked as consumer provisions do not apply to them.

3. Conclusion of the contract and payment

The contract is concluded when you submit the order at checkout and I confirm it by e-mail. I archive the order and make it available on request. The contract is concluded in Czech (or in English, according to the language version of the site) and is governed by Czech law.

You can pay by payment card. Prices are in Czech koruna (CZK); for foreign payments the exchange rate is set by the payment provider. Access to the content starts once the payment is received.

4. Access to digital content

Content bought with a one-off payment is available without a time limit for as long as the platform operates. If I shut the platform down, I will announce it at least 12 months in advance and let you download the content you bought in a common format.

Technical requirements: a current version of a common browser, an internet connection, a user account. The content is text (HTML) and, where applicable, video played directly in the browser. For as long as the content is offered, I keep it working and available (Section 2389d et seq. of the Czech Civil Code).

5. Membership

  • Membership is paid in advance per month or per year (depending on the chosen plan) and renews automatically for the next period until you cancel it.
  • You can cancel at any time in your account settings or by e-mail; the membership ends at the end of the paid period. I do not refund the unused part of the period.
  • I will announce a price change at least 30 days before it takes effect. If you do not agree with it, you can cancel the membership before the effective date.
  • Payment card details are stored by the payment provider; I have no access to them.

6. Withdrawal from the contract (consumers)

A consumer may withdraw from the contract within 14 days of its conclusion without giving a reason (Section 1829 of the Czech Civil Code).

One-off digital content: the right of withdrawal is lost if, before delivery, you expressly agree to delivery before the end of the withdrawal period and acknowledge that you thereby lose the right to withdraw (Section 1837(l) of the Czech Civil Code). You give this consent by a separate, unticked checkbox at checkout; I will confirm its wording in the purchase e-mail. Without the consent you get access only after the 14-day period has passed.

Membership: the same consent is required for the first period. If you do not give it and withdraw, I will refund a proportional part for the time during which the membership was not available to you.

Send your withdrawal to security [at] krisisnew.xyz; an unambiguous statement is enough, no form is required.

7. Refunds

I refund the money within 14 days of the withdrawal, using the same method you paid with. Another refund method only by agreement, at no extra cost to you.

8. Account and no sharing

The account is personal. Sharing login credentials or making paid content available to third parties breaches these terms. The account may be used in at most 3 concurrent sessions.

On the first breach I will suspend the account and ask you to remedy it. On a repeated or gross breach (e.g. public distribution of the content) I will terminate access; for a membership without a refund of the current period.

9. Text and data mining (TDM) reservation

I expressly reserve the rights to text and data mining under Section 39c of the Czech Copyright Act (Act No. 121/2000 Coll.) and Article 4(3) of Directive (EU) 2019/790. Using the content of this website to train machine-learning models without a licence is prohibited. Machine-readable reservation: /.well-known/tdmrep.json.

10. Complaints and defective performance

Rights arising from defective digital content are governed by Section 2389a et seq. of the Czech Civil Code. Report a defect to security [at] krisisnew.xyz; I will resolve it without undue delay, at the latest within 30 days. Unavailability caused by your device or connection is not a defect.

11. Changes to the terms

For memberships I reserve the right to change these terms. I will announce a change by e-mail at least 30 days before it takes effect. If you do not agree with it, you can cancel the membership before the effective date; otherwise you are deemed to accept the change. Content bought with a one-off payment is governed by the version of the terms in force at the time of purchase.

12. Personal data

The processing of personal data is described in the separate Privacy Policy.

13. Disputes

The Czech Trade Inspection Authority, www.coi.cz, is competent for out-of-court resolution of consumer disputes. Compliance with the Czech Trade Licensing Act is supervised by the trade licensing office.
